Terms of Service

1. Agreement and eligibility

By creating an account, purchasing credits or using the service, you agree to these Terms and the Privacy Policy. If you use NameGender for an organisation, you confirm that you can accept these terms for that organisation.

You must be legally able to enter into a binding agreement. If you do not accept these terms, do not use the service.

2. What NameGender provides

NameGender provides probabilistic classification based on names, extracted names from email addresses or usernames, optional country information, reference datasets and configured fallback methods. It also provides API access and tools for processing CSV and spreadsheet files.

A result describes a statistical association in the available data. It does not establish a person’s identity, biological sex, legal gender or self-identified gender.

3. Responsible use

You are responsible for deciding whether the service is suitable for your purpose and for complying with privacy, anti-discrimination, employment, consumer and other applicable laws.

• Do not use a result as the sole basis for employment, credit, housing, healthcare, education, insurance, law enforcement or another decision that produces a legal or similarly significant effect.
• Do not present a probabilistic result as a verified fact about an individual.
• Provide a lawful basis and any required notice before sending personal data to the service.

4. Accounts and API keys

Account information must be accurate and current. You are responsible for activity performed through your account and for keeping passwords and API keys confidential.

API keys may be restricted by IP address or origin and may be revoked from the dashboard. Notify support promptly if you believe an account or key has been compromised.

5. Acceptable use

• Do not bypass quotas, rate limits, authentication, access controls or the protected public demo.
• Do not resell access by exposing an unrestricted public proxy unless a written agreement permits it.
• Do not probe, disrupt or overload the service, distribute malware, or attempt unauthorised access.
• Do not use the service or its output for unlawful discrimination, harassment, surveillance or identification of sensitive traits.
• Do not submit data that you are not authorised to process.

6. Your data

You retain your rights in data you submit. You grant the operator a limited right to process that data only as needed to provide, secure and support the requested service and to meet legal obligations.

Input and result files are retained for the period stated in the Privacy Policy. You should download completed results promptly and keep your own backup.

7. Credits, prices and payment

One successfully processed item normally consumes one credit. The applicable cost is shown before a batch starts and in the API documentation. Purchased credits do not expire unless required by law, refunded, reversed because a payment failed, or removed to correct fraud or an accounting error.

Free daily credits have no cash value and reset according to the published plan. Prices, supported payment assets and packages can change for future purchases. A completed purchase is governed by the price displayed when the payment order was created.

8. Availability and changes

We aim to keep the service available and compatible, but maintenance, security events, upstream providers or network conditions can interrupt it. No uninterrupted availability is promised unless a separate written service-level agreement applies.

We may improve, add or retire functionality. Material breaking API changes will be communicated through documentation or account contact information when reasonably possible.

9. Intellectual property

The service software, interface, documentation and branding belong to the operator or its licensors. Open data and open-source components remain governed by their own licences. These terms do not transfer ownership to you.

You may use API results in your lawful internal workflows and customer-facing products, subject to these terms. You may not copy the service, extract the reference database in bulk, or use automated requests to recreate a competing dataset.

10. Suspension and termination

You may stop using the service at any time. We may limit or suspend access when necessary to prevent abuse, protect users or infrastructure, comply with law, investigate fraud or address a material breach of these terms.

Where practical, we will provide notice and an opportunity to correct the issue. Immediate action may be required for security, fraud, unlawful activity or risk to other users.

11. Disclaimers and liability

The service and its statistical results are provided on an as-available basis. To the extent permitted by law, we do not warrant that every result is accurate, complete or suitable for a particular decision.

To the extent permitted by applicable law, the operator is not liable for indirect, incidental, special or consequential loss, lost profits, loss of goodwill or decisions made from misinterpreting a probabilistic result. Nothing in these terms excludes liability that cannot legally be excluded.

12. Applicable law and changes to these terms

These terms are governed by the law stated in the operator’s legal configuration or, if none is stated, the law applicable at the operator’s registered office. Mandatory consumer protections and legally competent courts remain unaffected.

We may update these terms to reflect service, legal or security changes. Material changes take effect after reasonable notice. Continued use after the effective date means that the revised terms apply to later use.
